The bench comprising Justice Anwar Zaheer Jamali and Justice Maqbool Baqer passed the orders during hearing of a constitution petition filed by Khatiawar Co-operative Housing Society which moved the court against raising of illegal structures by some of its member/purchaser.
When the matter came up for hearing, Anwar Ali Shah, counsel for KBCA sought time for submitting the compliance report regarding an order passed by a division bench of SHC on 19-3-2002 and subsequent orders in the matter.
We have gone through the record of the case and notice with great concern that not only the compliance of order has not been made by KBCA for such a long period but even total disrespect has been shown to subsequent orders, the bench said in its order on Friday directing KBCA's chief controller to submit names of all officer concerned who were responsible for such delay in action within three days time.
The bench said that afterwards, show cause notices would be issued against said officers for their personal appearance before the Court on next date of hearing. The bench also asked the KBCA to furnish particulars of owners of property who have constructed the project as builders. The bench then put of further hearing till September 15.
